Jury Awards $50 Million to California Man Burned by Starbucks Tea

A California man who suffered severe burns from a cup of tea he purchased at Starbucks has been awarded $50 million by a jury in a recent ruling. The incident occurred in 2018 when Tommy Piluyev, a former firefighter, stopped at a Starbucks drive-thru in Roseville, California, and ordered a venti-sized hot tea.

According to Piluyev’s lawsuit, the lid on the cup was not secure and as he attempted to take a sip, the scalding hot tea spilled onto his lap, causing second-degree burns to his pelvic area and genitals. The burns were so severe that Piluyev had to undergo multiple surgeries and skin grafts, and he continues to suffer from chronic pain and physical limitations.

During the trial, Piluyev’s attorneys argued that Starbucks was negligent in serving the tea at an unsafe temperature and failing to provide a properly secured lid. They also presented evidence that Starbucks had received numerous complaints about similar incidents in the past but had failed to take adequate measures to prevent them.

In response, Starbucks claimed that Piluyev was partially at fault for the incident, arguing that he should have been more careful in handling the hot tea. However, the jury ultimately sided with Piluyev and awarded him $50 million in damages, including $5 million for past pain and suffering, $20 million for future pain and suffering, and $25 million in punitive damages.

The verdict has sparked a debate about the responsibility of businesses to ensure the safety of their products and the potential consequences of negligence. Many have criticized Starbucks for prioritizing profits over customer safety and failing to take appropriate action to address the issue of hot beverage spills.

In a statement following the ruling, Piluyev expressed relief and gratitude for the jury’s decision, stating that he hoped the verdict would send a message to Starbucks and other companies about the importance of prioritizing customer safety. He also emphasized the long-term physical and emotional impact of the incident on his life, and the need for accountability and justice.

Overall, the case serves as a reminder of the potential dangers of hot beverages and the importance of businesses taking proactive measures to prevent accidents and injuries. As consumers, it is important to be aware of the risks associated with hot drinks and to hold companies accountable for their actions in ensuring customer safety.
